"The Governor's discretionary powers sit uneasily with the spirit of cooperative federalism." Discuss.
The Constitution grants the Governor discretion under Articles 163 and 200, intended as a safety valve. In practice, discretion has widened into government formation, reservation of bills and even summoning of the assembly.
Name the case: Nabam Rebia (2016) fits perfectly here.
Cooperative federalism, by contrast, treats states as equal partners. When discretionary power is exercised without stated reasons, it converts a constitutional head into a political actor and erodes trust between the Union and the states.
